Terms of Service

§ 1 General Provisions, Scope of Application

1.1 All deliveries and services are carried out exclusively on the basis of the following general terms and conditions (hereinafter "GTC") in the version valid at the time of the order.

1.2 The contracting party is Next Level Foods GmbH, Rohnen 3, 9411 Schachen. The aforementioned contracting party is hereinafter referred to as "Seller".

1.3 For the purposes of these terms and conditions, a customer can be either a consumer or a business (hereinafter referred to as "Customer"). Consumers, as defined in these terms and conditions, are natural persons who enter into contracts for purposes that are predominantly neither related to their commercial nor their professional activities. Businesses, as defined in these terms and conditions, are natural or legal persons or partnerships with legal capacity who, when entering into a contract with the seller, are acting in the course of their commercial or independent professional activities.

§ 2 Conclusion of contract

2.1 Our offer is binding. By placing your order, you accept our offer to conclude a contract. The contract is concluded upon dispatch of your order to us. You will receive an order confirmation by email.

2.2 Once you have found the desired product, you can view it in more detail without obligation by clicking on the product name, the product image, or the "Order" button. By clicking the "Add to Cart" button, you can add the item to your shopping cart. You can view the contents of your shopping cart at any time by clicking on the shopping cart icon in the shopping cart window that opens. You can change the quantity of products or remove items from your shopping cart by adjusting them or by clicking the "X" button. If you wish to purchase the products in your shopping cart, click the "Checkout" button on the "Shopping Cart" page.

During the order process, you can log in to your customer account or enter additional contact information for shipping. After clicking the "Proceed to Shipping" button, you can select your shipping options. Clicking the "Proceed to Payment" button takes you to the next step of the order process, where you can select your preferred payment method. In the final step, under "Review Order," you will see an overview of your order details and can review and correct your information by clicking "Edit." You can also correct input errors by using the provided buttons to return to previous order steps, navigating backward in your browser, or canceling the order and starting over. On the "Review" page, you will find our terms and conditions and cancellation policy. To complete your purchase, click the "Buy" button.This sends the order to us.

§ 3 Storage

We save your order, the order details you entered, and the entire contract text. We will send you an order confirmation and order receipt by email, containing all order details and the complete contract text. You also have the option to print both the order and the terms and conditions before submitting the order to us.

§ 4 Prices, shipping costs

All prices include VAT and exclude shipping costs. We ship via DPD or another carrier of our choice.

§ 5 Terms of Delivery

5.1 We deliver exclusively to the following countries: Germany, Austria, Luxembourg, Italy, Spain, France, Poland, Czech Republic, Netherlands, Sweden, Norway, Monaco, Finland, Belgium, Hungary, Slovenia, Slovakia, Bulgaria, Romania, Denmark, Portugal and Greece.

5.2 Shipping

Unless otherwise stated in the respective offer, delivery of goods within Germany takes 3-5 days, and for deliveries abroad, 5-7 days after conclusion of the contract.

If you have ordered items with different delivery times, we will send the goods in one shipment, unless we have made a different agreement with you. In this case, the delivery time is determined by the item with the longest delivery time that you have ordered.

§ 6 Payment Terms

6.1 Payment can be made optionally via: Apple Pay, Google Pay, credit card (VISA, Mastercard, Maestro, Amex), instant bank transfer (Klarna Sofort), Klarna Sofort, Pay Later and Pay Now, PayPal, Amazon Payment.

6.2 For consumers, we retain title to the goods until full payment of the invoice amount. If you are an entrepreneur acting in the course of your commercial or self-employed professional activity, a legal entity under public law, or a special fund under public law, we retain title to the goods until all outstanding claims arising from the business relationship with the buyer have been settled.

§ 7 Warranty

7.1 If you are a consumer, the warranty is governed by the statutory provisions.

7.2 If you place your order with us as a business customer, the following applies: a) Delivered goods must be inspected by the customer immediately upon delivery. If a defect is found, we must be notified immediately.

§ 8 Liability

8.1 If you are a consumer, we are liable for damages in accordance with the statutory provisions.

8.2 If you place your order with us as an entrepreneur, the statutory liability rules apply.

§ 10 Legal system, place of jurisdiction

10.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 The place of jurisdiction is the registered office of our company in Lörrach.

§ 11 Miscellaneous

11.1 The contract language is German.

11.2 If one or more provisions of these General Terms and Conditions are invalid, the remainder of the contract shall remain valid.
